Trademarks
We offer a full array of trademark services. Our practice has managed thousands of trademarks, and performed due diligence searches for some of the largest brands in the world. There is not a trademark that our firm cannot handle. We have the capacity to add large corporate trademark portfolios to our management system, and offer low-priced maintenance for maintaining large portfolios of trademarks.
 
TechLaw LLP’s trademark staff currently have the capacity to manage single-trademark owner’s marks, as well as portfolios of more than 100 trademarks. Our trademark partner Dana Robinson can perform exhaustive searches and analyses for trademarks to ensure that the client does not infringe a third party’s rights, but also to ensure that the trademark selected can be protected, not simply registered. We argue against the USPTO whenever possible, and often take trademarks that other law firms have “given up” on, and argue them through to registration.

Copyrights are the rights that arise when a “creative” work is created.  This area of law is often the most overlooked area of intellectual property in today’s entrepreneurial businesses.  Ownership of creative works vests in the creator of the work, “in the absence of an agreement to the contrary.”

Do you actually own your website, or does the consultant that built it?
 
Unless you have an agreement that says explicitly that its yours, it belongs to your consultant.

Does your company expect to enforce its copyrights if infringed? 
 
If you don’t register your copyright within 5 years of publication, you can’t ever sue for infringement.

Does your accounting department want to amortize your intellectual

If you don’t consummate your IP expenses with proper registrations, you cannot avail yourself of the GAAP rules that allow certain IP expenses to be capitalized, and amortized over many years.
 
Copyright registration is fairly straightforward.  If we have properly documented that the client owns the creative works, we file a two page form with the Library of Congress with a small fee and normally the process leads to a copyright registration within a year.  Some common registrations that we have filed recently:

Trade Secrets
Trade secret law protects proprietary information so long as it is kept secret.  The classic example of a trade secret is KFC's Secret Recipe of 11 Herbs and Spices or the secret formula for Coca-Cola. Companies like Monsanto must use trade secrets to protect its formulations because no other area of law grants protection to the contents of a formulation or a recipe.  
 
One essential element of protecting trade secrets is the non disclosure agreement (NDA) that requires a person to agree NOT to disclose a company’s secrets. However, beyond the typical NDA there are a variety of means to protect secrets from disclosure. As IP attorneys, TechLaw LLP offers legal counseling for its clients on ways to protect its trade secrets.
 
Incorporation and Business Services
TechLaw LLP offers basic corporate service to its clients. We find that our clients often need an LLC formed to own a patent, or a corporation formed to exploit a new business opportunity. Rather than having these services handled by unrelated attorneys or firms, we offer affordable incorporation in any state.
